Certification of trade and port customs

The Ukrainian Chamber of Commerce and Industry certifies trade or port customs adopted in Ukraine within the scope of powers provided for in the second paragraph of the third part of Article 14 of the Law of Ukraine "On Chambers of Commerce and Industry in Ukraine" and its Statute, taking into account the provisions of Article 7 of the Civil Code of Ukraine, Article 32 of the Commercial Code of Ukraine, Article 3 of the Law of Ukraine "On Sea Ports of Ukraine" and other regulations.

Certification is preceded by the analysis of the trade or port customs adopted in Ukraine, which is carried out by the specialists having a scientific degree in the respective scientific specialty in different branches of science in order to confirm the conformity of trade or port customs with the requirements of customs as a source of regulation of legal relations in the respective sphere of economic activity (business circulation) and absence of contradiction to the acts of legislation of Ukraine and other customs in business circulation (if any) for their further verification.

To certify trade and port customs at the Ukrainian Chamber of Commerce and Industry, the following documents are to be attached to the order:

• trade or port customs in 2 (two) copies, issued in compliance with the following requirements:
• font Times New Roman;
• size 14;
• fields: left - 30 mm, right - 15 mm, upper and lower - 20 mm;
• interval - 1.5;
• A4 format;
• pages are numbered in the bottom part of the sheet in the right corner, no page number is marked on the front page;
• the title page indicates: in the middle - in large letters - the name of trade and port customs; in the lower part - in the middle - the name of the region and year of publication; in the upper right corner:

• copies are not stitched;
• a copy of the act on publication of trade or port customs, certified at the place of publication, in one copy;
• copy of mandatory port regulations or other acts related to trade or port customs, certified by the Customer in one copy;
• an extract from the Unified State Register of Legal Entities, Physical Entities - Entrepreneurs and Public Formations on state registration of the Customer;
• written explanation of the Customer regarding trade or port customs submitted for confirmation, which should include: the need to publish them; definition of the sphere of economic activity in which they are sufficiently known; legal framework and the nature of their application; correlation with specific regulations and other customs established in the business turnover.

If necessary, the Customer may be required to provide additional documents and written justification of the provisions formulated in the text of trade and port customs.

Certification of trade and port customs adopted in Ukraine is the provision of legal force to trade and port customs, confirming their compliance with the requirements of the customs as a source of regulation of legal relations in the relevant sphere of economic activity (business circulation) and the absence of contradiction to acts of Ukrainian legislation and other customs in business circulation (if any).

Trade and port customs as a source of regulation of legal relations shall comply with the following requirements:

• have the character of a general rule, formed due to repeated and long uniform application (stable)
• be sufficiently known in the relevant sphere of economic activity (business circulation);
• to be defined by its content (correctness, absence of contradiction, completeness of presentation)
• not to be established acts of Ukrainian legislation.
